Session Fee/Scheduling/Rescheduling:

Client’s session fee is due in full within ten days of signing this contract, or the date will not be held. Credit/Debit card payment will be requested through PayPal.

Session fees hold your session date and are non-refundable. Up to two non- weather-related reschedules are permitted. However, Monson Photography does not guarantee availability for the same timeframe or day of the week as originally committed to. Upon the third rescheduling, a $25 reschedule fee will be issued. Clients who do not show up for a session and do not call at least two hours before the scheduled session time to cancel or postpone will not be rescheduled and the session fee will not be refunded.

Session Fee Acknowledgement:*

I understand that my session fee is due within 10 days of scheduling to hold my date. I understand that this fee is non-refundable once collected. Changes to my selected date cannot be guaranteed.

Retouching:

It is Monson Photography’s policy to not remove any permanent scars or birth marks unless directed to do so by the Client.

"PROOF" images posted to Client galleries will NOT be edited, other than minor technical corrections if necessary. Monson Photography may perform Basic Portrait Editing (see below) on select images to demonstrate what purchased images will look like.

Basic Portrait Editing (backdrop retouching, blemish/scratch retouching, teeth whitening, softening of the under eye area where necessary, contrast/sharpening and long stray hair removal) is included with any image the Client orders, whether electronic or print form. Editing of ordered images begins once payment is collected for the order.

Extensive editing is available for purchase at a price of $25.00 per image at the Client’s request. This includes, but is not limited to: Braces removal, excessive tan line removal, and subtle face or body slimming.

Retouching Acknowlegement:*

I understand that my proofs will NOT be edited, but that the portraits I order will be. I understand that extensive editing is done at an additional charge, at my request.

Proofs Acknowledgement:*

I understand that I will only see "the best of the best" images from my session. I understand that these images will NOT be fully edited when I first view them.

Copyright/Digital images/Social Media:

Scanning and printing of images or copying ("screen shot captures") images, including screen captures from the Monson Photography website or Facebook page is unlawful due to copyright protection. If a client has purchased digital images from Monson Photography, the client agrees to the reproduction terms outlined in this document.

Copyright Acknowledgement:*

I understand that it is unlawful to scan or copy images, including printed portraits that I have purchased.

Sharing/Social Media Acknowledgement:*

I understand that my gallery will allow me to share photos directly to Facebook, Pinterest, and Twitter. I agree to use the sharing button in my gallery and will not screen capture or right-click/save my images. If I am sharing via purchased digital images, I will credit Monson Photography for creating the images.

Liability

Monson Photography would never put a Client in danger of any way. However, Monson Photography shall not be held responsible for any injuries obtained by any participating parties. Client(s) will be responsible for their children and for themselves and release photographer from any claims against their person or their business.

Liability Acknowledgement:*

Monson Photography won't put me or my family in harm's way, but should we suffer accidental injury during our photo session, Monson Photography will not be liable for medical expenses or compensation due to injury.

Model Release

In exchange for consideration received, the undersigned hereby give permission to Monson Photography, for the unrestricted use of their names and photographic likeness, as well as any and all photographic images of their session created by Monson Photography, in all forms and media for advertising, marketing, trade, and any other lawful purpose. Permission is granted for images to be combined with other images, text, and graphics, and cropped, altered, or modified. Client(s) and/or parent/guardian further forever release Bethany Monson, Monson Photography, from any and all claims or actions arising out of or in conjunction with the use of said images.

Client hereby gives to Monson Photography the absolute and irrevocable right and permission with respect to the photographs that he/she has taken of the Client and/or minor child in which he/she may be included with others:

a) To copyright images in the photographer’s name;

b) To use, re-use, publish and re-publish the same in whole or in part, separately or in conjunction with other photographs, in any medium now or hereafter known, and for any purpose whatsoever, including (but not by way of limitation) illustration, promotion, advertising and trade, and;

I hereby release and discharge photographer from all and any claims and demands ensuing from or in connection with the use of the photographs, including any and all claims for libel and invasion of privacy.

If Client does not wish for Monson Photography to use their likeness for advertising, they must put this request in writing.

Model Release:

I understand that by entering this contract with Monson Photography, I am allowing permission for my images to be used for advertising purposes, including Facebook, the Monson Photography website/blog, and marketing fliers/business cards. If I do NOT agree to share my images, a request must be made in writing to Monson Photography.

Contractual Agreement*

I have read, understand, and agree to the terms set forth in this contract by Monson Photography. By signing this document, I agree to pay Monson Photography the agreed upon session fee within 10 days of signing this contract.
